The petitioner seeks bail in connection with Minapur P.S. Case No.77 of 2024 registered for the offence under Sections 379, 401, 413, 414/34 of the Indian Penal Code and Sections 25(1-b)a, 25)(1-A), 25(1-AA), 26 and 35 of the Arms Act.

As per the prosecution case, the allegation against the petitioner is that he along with three co-accused persons arrested with stolen motorcycle. It is further alleged that one country made pistol was also recovered from the possession of the petitioner.

Learned counsel appearing on behalf of the

Patna High Court CR. MISC. No.61421 of 2024(2) dt.18-10-2024 2/3 petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that nothing has been recovered from the possession of this petitioner, which may connect him with the present set of occurrence. It is submitted that similarly situated co-accused persons have already been granted bail by this Court through Cr. Misc. No.49641 of 2024 on 22.07.2024 and Cr. Misc. No.54582 of 2024 on 09.08.2024. It is further submitted that petitioner is in custody since 27.02.2024.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner and as nothing has been recovered from the possession of this petitioner and as similarly situated co-accused persons have already been granted bail by this Court, let the petitioner, above named, is directed to be released on bail, in connection with Minapur P.S. Case No.77 of 2024 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court No.8, J.M.F.C., Muzaffarpur East/concerned court.

7. The petitioner shall be physically present on each

No.61421 of 2024(2) dt.18-10-2024 3/3 and every date before the Trial Court till conclusion of the trial and if the petitioner would absent for two consecutive dates without any cogent reason, the bail bonds of the petitioner shall be cancelled by the learned trial court itself.
