2. The petitioners are apprehending arrest in connection with Raghopur P.S. Case No. 424 of 2024 lodged on 17.12.2024, for the offence punishable under Sections 191(2), 191(3), 190, 126(2), 115(2), 109, 303(2), 352 of the Bharatiya Nyaya Sanhita, 2023 and later on section 103(1) of the B.N.S. has been added, pending in the Court of A.C.J.M.-I, Supaul at Birpur.

As per the prosecution, FIR has been lodged against 12 named accused persons including the present petitioners against whom there is an allegation that they have assaulted the informant, her husband and her father-in-law by lathi, danda, iron rod due to which injury has been caused. Accused persons also snatched Rs.40,600/- from the pocket of husband of the informant. Subsequently, the father-in-law of the informant was admitted to hospital due to his serious condition. Thereafter, father-in-law of the informant died after two months of the alleged occurrence.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence. Counsel submits that the petitioners have been falsely implicated in this case due to dirty village politics and there is general and omnibus allegation against the accused persons. Counsel submits that the father-in-law of the informant died in his house after two months of the alleged occurrence which shows that the petitioners have wrongly implicated in this case. Counsel further submits that the petitioners have no criminal antecedent.
5. Learned APP for the State opposes the prayer for bail of the petitioners and submits that the Sessions Judge has

No.56061 of 2025(2) dt.27-08-2025 3/3 acknowledged in the rejection order that per the post mortem report, the doctor has found the cause of death as C/R failure due to neurological post operative complication leading to multi organ failure. The I.O also recorded the supervision report and found the case true against the present petitioners and accused namely, Sandeep Yadav.
6. In the present facts and circumstances, this Court is not inclined to grant bail to the petitioners. Accordingly, the prayer for anticipatory bail of the petitioners are hereby rejected with liberty that if, petitioners surrenders before the concerned Trial Court within a period of six weeks from today then in that case, the Trial Court is directed to pass order on their surrendercum-bail application on the same day considering the observations made in the rejection order as per case diary, without being prejudice that the anticipatory bail of the petitioners have been rejected by this Court and the Trial Court shall pass order on the merit of this case.
