Act. Complaint Case No. C.A. 337 of 2010 was registered in Alamganj police station. The petitioner filed A.B.P. No.2089 of 2011 in the court of learned Sessions Judge, Patna, which was rejected through order dated 29.6.2012. Hence, this application for grant of anticipatory bail under Section-438 of Cr.P.C. Heard learned counsel for the petitioner and learned A.P.P. for the State.
This case is, in a way, an example as to the manner in which the summary matters like applications for anticipatory bail are dealt with. For the past three years it is pending and the record has grown to such a
Patna High Court Cr.Misc. No.24637 of 2012 (9) dt.10-03-2015 2/2 level as though it is a heavily contested property dispute and at the end of the day, the only allegation against the petitioner is referable to Section-498A of I.P.C. As such, the application is allowed.
In the event of arrest, the petitioner is directed to be released on bail upon furnishing the bailbond of Rs.10,000/- (ten thousand) along with two sureties of the like amount each to the satisfaction of S.D.J.M., Patna City in connection with C.A. No.337 of 2010.
