ANJANA MISHRA ORAL ORDER 08-08-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State.

The petitioner is apprehending his arrest in connection with Barachatti (Mohanpur) P.S. Case No.243 of 2014 registered for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

Case diary was called for, which has since been received.

After hearing learned counsel for the petitioner, it appears that the only allegation made against him is that during the course of investigation, one witness stated that he has seen this petitioner as well as other four persons, namely, Jagjiwan Das, Ajay Das, Anil Kumar and Rambilash Das going with the

Patna High Court Cr.Misc. No.20358 of 2016 (3) dt.08-08-2016 2/2 deceased Mamta Devi.

Learned counsel appearing on behalf of the State, after perusal of the case diary submits that save and except this statement, there is no other cogent material in the case diary to indicate any connection between this petitioner and the deceased lady and at best it can be treated as the case of last seen. In view of the aforementioned facts and circumstances, let the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/ production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatti (Mohanpur) P.S. Case No. 243 of 2014 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
