The petitioner apprehends his arrest in Sikandara P.S. Case No. 139 of 2016 registered for the offences punishable under Sections 354, 366(A)/511, 506 and 323 of the Indian Penal Code and under Sections 10 & 12 of the POCSO Act.

The informant filed complaint case making allegation that Pappu Kumar, son of the petitioner used to stop her and when father of the complainant and others went to complain the petitioner and others assaulted them.

Learned counsel for the petitioner submits that all the allegations are false and concocted. Pappu Kumar and mother of Pappu Kumar have already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 45773 of 2016. The case of the

Patna High Court Cr.Misc. No.11309 of 2017 (2) dt.04-04-2017 2/2 petitioner stands on the better footing.

Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Ist Additional District & Sessions Judge (Special Judge), Jamui in Sikandara P.S. Case No. 139 of 2016, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
