====================================================== CORAM: HONOURABLE MR. JUSTICE SANJAY PRIYA ORAL ORDER 25-09-2018 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners seek bail in Banka P.S. Case No. 383/2017, instituted for the offences under Sections 379 and 411 of the Indian Penal Code.

It is alleged in the written report that motorcycle of the informant was stolen when he had gone to market for purchasing some articles. It is alleged that the informant enquired from nearby persons and learnt that two boys have taken his motorcycle towards Banka. It is further alleged that these petitioners were identified by informant, who were riding the aforesaid motorcycle. Thereafter, police was informed and these petitioners were arrested.

Report of the court below has been received wherein it is mentioned that the case is running for defence evidence. Keeping in view the period of custody of the petitioners, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Banka P.S. Case No.

383/2017, subject to the conditions that (i) both the bailors shall be the close relative of the petitioners (ii) petitioners shall cooperate in the trial and shall be present on each and every date fixed by the court and absence on two consecutive dates without valid reason will amount to cancellation of bail bond of the petitioners and (3) if petitioners tamper with the evidence, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
