JUSTICE MADHURESH PRASAD ORAL ORDER 30-09-2019 Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State. Petitioner seeks bail in a case registered under sections 30/30(g), 38(I) (II) of Bihar Prohibition & Excise Act, 2016. Petitioner is alleged to have been arrested from the same vehicle from where co-accused Prabhat Ranjan has been apprehended. Some Indian made foreign liquor and beer bottles are said to have been recovered from the vehicle in question. Co-accused Prabhat Ranjan as per submission of counsel for the petitioner has been allowed bail in Cr. Misc. no.48656/2019 on 09.08.2019.

It is submitted that petitioner has no criminal antecedent and is in custody since 11.06.2019. Considering the aforesaid submissions and having

Let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of the Special Judge (Excise cases)-cum A.D.J XI, Saran in Manjhi P.S. Case no. 158/2019 subject to the following conditions.

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
