2. The petitioner has prayed for bail in a case registered for the offence punishable under sections 147, 148, 149, 307, 504, 506, 379, 302 of the Indian Penal Code.
3. As per allegation in the FIR, informant had gone to mediate a quarrel which was happening before his house, in the meanwhile, accused Vijay Mandal assaulted him with farsa and he sustained head injury. When his nephew and brother came there to same him, they were also assaulted by accused Raju Mandal, Vikash Mandal and others by means of axe and danda resulting into their head injuries.
4. It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He is not
Patna High Court CR. MISC. No.63242 of 2023(2) dt.09-10-2023 2/2 named in the FIR. He is student of B.Sc Part 2nd. He was simply a member of the mob. Similarly situated other accused person has already been enlarged on bail by another coordinate Bench of this Court vide order dated 21.2.2023 passed in Cr. Misc. No. 56268 of 2022. Petitioner has got no criminal history and languishing in judicial custody since 5.6.2023.
5. The application for bail is opposed by learned APP for the State.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned CJM, Madhubani in connection with Pandaul PS Case No. 229 of 2020.
