The petitioners seek pre-arrest bail in connection with Mashrakh P.S. Case No. 73 of 2016 registered under Sections 420, 406 and 120B of the Indian Penal Code.
Regard being had to the nature of allegation as also the fact that the case is based on a complaint and apart from oral allegation, there is no document to support that the informant ever handed over any amount to the petitioners, Bablu Kha and Maneri Kha, in the event of their arrest or surrender in the court below within six weeks from today, they are directed to be released on bail on furnishing bail bond of Rs.10,000/-(ten thousand) each
Patna High Court Cr.Misc. No.21300 of 2016 (2) dt.25-05-2016 2/2 with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-VIII, Saran, Chapra in connection with Mashrakh P.S.Case No.73 of 2016 subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
