The petitioners are apprehending their arrest in connection with Lauriya P.S. Case No 110 of 2016 lodged for the offences punishable under Sections 302 and 201/34 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that the petitioners are not named in the FIR rather they have been made accused during the course of investigation and at that time no specific allegation has been alleged against the petitioners. It has also been submitted that dead body of the deceased was also later on recovered and sent for post mortem and found that she died due to drowning and the story of burning

Patna High Court Cr.Misc. No.14851 of 2017 (2) dt.06-04-2017 2/2 the dead body is also false and considering the aforesaid fact, this Court has granted anticipatory bail to the other co-accused persons by order dated 19.01.2017 passed in Cr. Misc. No. 47535 of 2016.

Having heard both sides and in view of the facts stated above, let the petitioners, above named, in the event of their arrest or surrender in the court below within a period of two weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, West Champaran in Lauriya P.S. Case No. 110 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and that the petitioners shall co-operate in the investigation of the case and appear before the police as and when required, otherwise, the prosecution is free to move for cancellation of his bail bonds.
