In the facts and circumstances of the case, the delay in filing the appeal is condoned.
I.A. No.2801 of 2015 is, accordingly, disposed of. Learned counsels for the parties agree that the present case is also covered by the decision dated 19.10.2016 of a Division Bench of this Court rendered in Civil Review No.16 of 2016, arising out of L.P.A. No.1491 of 2014 and its analogous cases. In the aforesaid circumstances, the present appeal is also disposed of in terms of the directions contained in the order dated 19.10.2016 passed in Civil Review No. 16 of 2016.
