JUSTICE SUDHIR SINGH ORAL ORDER 09-06-2015 The petitioner is languishing in custody since 01.11.2014 in connection with Sessions Trial No. 190-A of 2012 arising out of Munger Mufassil P.S. Case No. 233 of 2004 for the offences instituted under section 3⁄4 of Explosive Substance Act. Heard learned counsel for the petitioner and learned counsel for the State.

The prosecution story, in brief, is that the informant Inspector of Police, Munger Mufassil Police Station got a secret information on his mobile phone that Md. Kamaluddin and his sons, namely, Imteyaz and Tawrej are dealing in the business of explosive substance since last several years. On getting this information the informant made a raiding party and proceeded to raid at the place of occurrence. It is alleged that on

Patna High Court Cr.Misc. No.15941 of 2015 (2) dt.09-06-2015 search of the house of the petitioner 25 bundles of wire and two packets of detonators were recovered and seized. It is submitted on behalf of the petitioner that no explosive substance has been recovered from the conscious possession of the petitioner. Whatever recovered is alleged to have been recovered from the house in the joint possession of the petitioner and other family members. The petitioner is in custody since 1.11.2014.

On behalf of the State, it has been submitted that the petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Ad-hoc Additional Sessions Judge VIII, Munger in connection with Sessions Trial No. 190-A of 2012 arising out of Munger Mufassil P. S. Case No. 233 of 2004.
