JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-02-2015 Heard learned counsels for the petitioners and the State. The petitioners being the husband and family members of the husband of the victim are apprehending arrest in a case registered for the offences punishable under Sections 323, 324 and 379/34 of the Indian Penal Code and Section 3/4 of the Dowry Prohibition Act.
It is alleged that after the marriage, the informant gave birth to two children but they subsequently died, thereafter, the informant has been tortured and driven out from matrimonial house.
It is submitted by learned counsel for the petitioners that earlier Complaint Case No. 1502C of 2012 was filed with similar
Patna High Court Cr.Misc. No.4625 of 2015 (2) dt.04-02-2015 2/2 accusation. Though, subsequently, the informant died at her parents' place for which father-in-law of the victim lodged Gopalpur P.S. Case No. 42 of 2014 against the victim's family making accusation under Sections 302 and 201/34 of the IPC. Considering the fact that the informant died at her parents' place, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Bettiah, West Champaran in connection with Gopalpur P.S. Case No. 48 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
