JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-08-2019 Petitioners seek bail in anticipation of their arrest in connection with Jehanabad Mahila P.S. Case No. 42 of 2016 registered for the offences punishable under Sections 376, 313, 120B, 504 and 506/34 of the Indian Penal Code. Prosecution case is that one Ravi Sharma on the assurance of marriage has made physical relationship with the informant and when she became pregnant, petitioners gave some medicine to her for miscarriage of her pregnancy and petitioners are family members of Ravi Sharma, who are alleged to have conspired with Ravi Sharma.
Patna High Court CR. MISC. No.52647 of 2019(2) dt.23-08-2019 2/2 Submission of learned counsel for the petitioners is that they have falsely been implicated only because Ravi Sharma is son of petitioner No.1 and that Ravi Sharma has already been granted anticipatory bail by a co-ordinate Bench of this Court by order dated 20.7.2017 passed in Cr.Misc.No. 24351 of 2017.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Jehanabad, in connection with Jehanabad Mahila P.S. Case No. 42 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
