Mr.Parmeshwar Mehta ====================================================== CORAM: HONOURABLE MR. JUSTICE SUDHIR SINGH ORAL ORDER 05-09-2019 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered under Sections 409 & 420 of the Indian Penal Code.

Allegedly, the petitioner overvalued the price of the land, over which, rice mill was installed.

It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 19-06-2019. Charge sheet has already been submitted. The petitioner is not named in the FIR. The petitioner has been falsely implicated in the present case. The name of the petitioner surfaced in this case in course of investigation. The petitioner had given valuation certificate in respect of the land, on which the rice mill in question was existing. The petitioner is alleged

Patna High Court CR. MISC. No.54990 of 2019(3) dt.05-09-2019 2/2 to have issued land valuation certificate by overvaluing the price of the land in question. The petitioner, being Circle Officer, put the signature upon the report submitted by the Revenue Clerk namely, Rajendra Kumar Srivastava who had done the valuation of the land in question. Except for this, no wrongful loss or wrongful gain has been made on the part of the petitioner in respect of the transaction of rice between the rice miller and Bihar State Food & Civil Supply Corporation.

On behalf of the State, it is submitted that the petitioner is not named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Kudra P.S.
