JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 21-02-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 307, 34 of the Indian Penal Code and Section 27 of the Arms Act.
It is alleged by the informant that all the F.I.R named accused persons including the petitioner surrounded the informant and co-accused Gulshan Kumar fired at him, as a result of which, he sustained fire arm injuries on his right buttock above leg and on

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely been implicated in this case. There is general and omnibus allegation against the petitioner of being part of an unlawful assembly. The accusation of firing is against co-accused Gulshan Kumar. The petitioner is languishing in custody since 15.06.2022.
Learned counsel appearing on behalf of the informant and learned A.P.P for the State have vehemently opposed the prayer for bail of the petitioner and submitted that petitioner was also part of an unlawful assembly.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Begusarai
