JUSTICE SUDHIR SINGH ORAL ORDER 21-07-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 413, 414 and 401 of the Indian Penal Code. Allegation against the petitioner is that stolen motorcycle was recovered from his house on the basis of confessional statement of co-accused Ranjit Yadav.

It has been submitted on behalf of the petitioner that he is in custody since 26.3.2016. Chargesheet has been submitted in the present case. Petitioner has got no criminal antecedent. There is no allegation of tampering of evidence against the petitioner. On the confession of co-accused Ranjit Yadav, the stolen motorcycle is said to have been recovered from the house of the petitioner. Petitioner had no knowledge that the said motorcycle is a stolen one.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances and the age of the petitioner, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten

Patna High Court Cr.Misc. No.20907 of 2016 (3) dt.21-07-2016 2/2 thousand only) with two sureties of the like amount each to the satisfaction of Sri Dinesh Kumar, Judicial Magistrate, Ist Class, Jhanjharpur, Madhubani, in connection with Khutauna P.S. Case no. 24 of 2016.
