The petitioner seeks bail in a case registered for the offences punishable under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act. The learned counsel for the petitioner submits that the petitioner is in custody since 16.06.2021, charge-sheet has been submitted in the case and has antecedent of two cases. Allegation is of recovery of one blue colour hacksaw (cutter) and a mobile from the pocket of the petitioner. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the present case. Merely carrying a cutter does not lead to an inference that petitioner was going to commit an occurrence.

Considering the fact that the petitioner is in custody, charge-sheet has been submitted in the case and in the nature of allegation, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Kotwali P. S. Case No.280 of 2021, subject to condition that one of the bailors shall be the wife of the petitioner namely, Angoori Khatoon. The application stands allowed.
