Petitioner seeks regular bail in connection with Jehanabad P.S. Case No. 475 of 2018 registered for the offence punishable under Sections 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

Prosecution case is that, due to the dispute with regard to payment for the cigarette taken by the accused persons, the accused persons including the petitioner assaulted the deceased and there is specific allegation against this petitioner also of firing on the deceased causing his death. Apart from that it appears that petitioner is accused in three other cases. Submission of learned counsel for the petitioner is that as a matter of fact, deceased Binod Kumar had shot at to one Amit Kumar who was taken to P.M.C.H, due to that

Patna High Court CR. MISC. No.53350 of 2019(6) dt.02-03-2020 2/2 villagers have assaulted the deceased. Petitioner is in custody since 08.02.2019.

Heard learned A.P.P. has also not controverted this fact.

In view of the submissions made above, let the petitioner above named, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned Chief Judicial Magistrate, Jehanabad in connection with Jehanabad P.S. Case No 475 of 2018.
