The petitioner has preferred this application for grant of regular bail in a case registered under section 392 of the Indian Penal Code.
As per the prosecution case, four accused persons on motorcycles on the point of firearm robbed the informant of his belonging as described in the FIR.
It is submitted by learned counsel for the petitioner that the FIR was registered against unknown. The name of the petitioner transpired in course of investigation in the confessional statement of co-accused Manish Kumar Choudhary. No incriminating article has been recovered from the petitioner's possession. Inspite of the petitioner being in custody since 5.2.2021, he has not been put on T.I. parade. The
Patna High Court CR. MISC. No.67346 of 2021(2) dt.26-04-2022 2/2 case of the petitioner stands on a similar footing to that of coaccused Sonu Paswan who has been enlarged on bail vide order dated 24.3.2022 passed in Cr. Misc. no. 50078 of 2021. Heard learned APP for the State.
Having heard learned counsel for the parties and taking into consideration the facts of the case, no incriminating article having been recovered from the petitioner's possession and the petitioner not having been put on T.I. parade inspite of being in custody for more than 1 year, the petitioner is directed to be enlarged on bail in connection with Dalsingsarai P.S. Case no. 216 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate, Dalsingsarai, Samastipur.
