====================================================== CORAM: HONOURABLE MR. JUSTICE SATYAVRAT VERMA ORAL ORDER 18-02-2022 Heard learned counsel for the petitioner and learned APP for the State.

The petitioner seeks bail in connection with Case No.C-III-358 of 2021, instituted for the offences under Section 30(a) of the Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 17.09.2021, he is a person with clean antecedent and prosecution report has been submitted in this case.

Allegation is of recovery of 204.675 litre of liquor from a Maruti Car from which the petitioner along with two other accused were arrested.

The learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.68032 of 2021(2) dt.18-02-2022 2/2 petitioner is neither the owner, nor the driver of the Maruti car, but had merely taken a lift and came to be implicated when search was made.

The learned counsel for the petitioner submits that Learned A.P.P. opposes the bail application.

Considering the fact that the petitioner is in custody, he is a person with clean antecedent and prosecution report has been submitted in this case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 2,000/- (Rupees Two Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd-cum-Special Judge, Excise, Siwan in connection with Case No.C-III-358 of 2021. The application stands allowed.
