The petitioner apprehends his arrest in a case registered for the offence under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code.

The petitioner is alleged to have obtained appointment, as Panchayat Teacher, on the basis of forged and fabricated document(s).

It is submitted on behalf of petitioner that after verification of all the educational qualifications including the BETET mark-sheet, petitioner was appointed by the concerned authority and he joined on the said post, but unfortunately, without giving any opportunity of hearing or notice, the document, submitted by this petitioner, has been declared to be forged & fabricated. Moreover, the petitioner has already been terminated from the service. Petitioner has got clean antecedent.

Patna High Court CR. MISC. No.61144 of 2022(2) dt.11-04-2023 2/2 Learned A.P.P. for the State and learned counsel for the Vigilance Department opposed the prayer for anticipatory bail.

Considering the aforesaid facts and circumstances as well as the fact that petitioner has been removed from the service and thus, he has sufficiently been punished coupled with the fact that he has got clean antecedent, let the above named petitioner, in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnea in connection with Jankinagar P.S. Case No. 134 of 2022, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
