JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 23-02-2017 Heard learned counsel for the petitioner and learned counsel representing the State.

The petitioner apprehends his arrest in connection with Hasanpur P.S. Case No. 64 of 2014, registered for the offences punishable under Sections 341, 323, 324, 308, 504/34 of the Indian Penal Code.

Allegedly, in the occurrence the petitioner assaulted with bottle of Beer with an intention to kill the informant on his head and co-accused Mohan Kumar Singh assaulted with butt of the pistol beneath eye and further they snatched gold chain. Submission is of false implication and that injury

Patna High Court Cr.Misc. No.6995 of 2017 (2) dt.23-02-2017 2/2 found on the person of the informant is simple in nature vide annexure-2, no sharp cut injury has been found rather the injury found is caused by hard and blunt substance and, as such, the petitioner deserves sympathetic consideration. The learned A.P.P. submits that on scalp injury has been found though simple in nature.

In the facts and circumstances as stated above, the petitioner in the event of his arrest or surrender within four weeks from the date of receipt/production of a copy of this order shall be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri D.K. Bhaskar, J.M. 1st class, Rosera, District Samastipur, in connection with Hasanpur P.S. Case No. 64 of 2014, subject to the conditions as laid down in section 438(2) of the Cr.P.C.
