Heard learned counsel for the petitioner and learned APP for the State.
Petitioner seeks bail in a case registered for the offences punishable under Sections 147, 148, 149, 307, 504, 506 of the Indian Penal Code and 27 of Arms Act. Allegation against the petitioner is that he caused injury with rifle at the chest of Indrajeet Kumar. Though exact injury report is not available with the case diary. However, the bed head slip of the injured would reveal that after X-ray report of the chest, surgical operation was performed after obtaining written consent from Lalan Kumar. It further shows that a case of firearm injury was noticed by
Patna High Court Cr.Misc. No.17460 of 2018 (7) dt.30-07-2018 2/2 the Doctor.
Submission of the learned counsel for the petitioner is that the petitioner is in custody since 19.01.2018. He is 40% handicapped from the right limbs. Report from the learned Trial Judge on physical verification of the petitioner was called for and the learned Trial Judge has also reported that the petitioner has some problem from the right limbs.
Considering the nature of allegation and the fact that the petitioner is a physically handicapped person, let the petitioner, above named, be released on bail on completion of nine months of custody on furnishing bail bond of Rs.20,000/- (Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Harnaut Police Station Case No.243 of 2017, subject to the condition that both bailors shall be resident of territorial jurisdiction of the learned court below and further the petitioner shall fully cooperate with the investigation/trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
