JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 20-04-2023 Heard learned counsel for the petitioners, learned APP for the State and learned counsel for the informant. The petitioners have prayed for grant of bail in connection with Amarpur P.S. Case No. 224 of 2022 registered under sections 304B and 34 of the Indian Penal Code.

Allegation against the petitioners along with other co-accused person is that they killed the grand daughter of the informant due to dowry demand.

Learned counsel for the petitioners submits that the

Petitioners are father-in-law and mother-in-law of the deceased due to which they have falsely been implicated in this case. It is further submitted that there is no prior complaint in respect of ill behaviour with the deceased against the petitioners. They have no concern with the alleged occurrence. It is also submitted that the full responsibility to maintain and behave well with the wife is upon the husband of the deceased. Postmortem report also asserts that the cause of death of the deceased is due to hanging. A statement has been made in para-3 of this petition that the petitioners have got no criminal antecedent. Moreover, they are languishing in judicial custody since 23.04.2022.

The application for bail is opposed by learned APP for the State and learned counsel for the informant. Having heard learned counsel for the parties and considering the facts and circumstances of this case as well as the custody of the petitioners, the Court is inclined to enlarge the petitioners on bail. The above named petitioners are directed to be enlarged on bail in connection with Amarpur P.S. Case No. 224 of 2022 on each of them furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties
