JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 01-08-2022 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 420/384 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. As a matter of fact, the petitioner being subordinate employee in the Transport office, Ara, he was duty bound to follow the instructions of his senior officials. On 10.7.2020 he was orally instructed by the DTO to perform his clerical part of duty during routine checking of vehicles and following instructions he remained present with the DTO, Ara. From perusal of seizure list (Annexure 2 ) it is clear that seized vehicles were released under the informant's signature.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate VI, Bhojpur at Ara in Narayanpur Police Station Case No. 71 of 2020, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
