The petitioner apprehends his arrest in Deep Nagar P.S. Case No. 140 of 2015, arising out of Complaint Case No. 388 C of 2015 registered for the offences punishable under Sections 409, 419, 420 and 34 of the Indian Penal Code.

The informant Awadhesh Kumar lodged the case making allegation of irregularity in giving money in Indira Awas Scheme. It is alleged that the petitioner and others given benefit of Indira Awas Scheme to the wrong persons.

It is submitted that no wrong has been done. The persons who get money under the Indira Awas Yojna returned the money. The co-accused Kamta Kewat has already been enlarged on anticipatory bail vide order passed in Cr. Misc. No. 14677 of

Patna High Court Cr.Misc. No.20470 of 2016 (3) dt.20-07-2016 2/2 2016. The petitioner is the Panchayat Sachiv and he issued the cheques on the order of Mukhiya.

Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Rajiv Kumar Trivedi, the Judicial Magistrate, Nalanda at Biharsharif in Deep Nagar P.S. Case No. 140 of 2015, arising out of Complaint Case No. 388 C of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Prabhat Kumar Jha, J.) KKSINHA/- U T
