====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 04-11-2025 Heard learned counsel for the petitioners and the State.

2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 103(1), 61(2) of the Bharatiya Nyaya Sanhita.

3. As per prosecution case, all the F.I.R. named accused persons, including these petitioners, took away nephew of the informant and subsequently, his dead body was recovered from the drainage.

4. Learned counsel for the petitioners submits that petitioners are innocent and have committed no offence. Informant is not an eye witness of the alleged occurrence. As

Patna High Court CR. MISC. No.57895 of 2025(3) dt.04-11-2025 2/2 per F.I.R., petitioners are only alleged to be last seen with the nephew of informant. There is no specific accusation of overt act against these petitioners. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State vehemently opposed the bail application.

6. Considering the fact that these petitioners were last seen with the deceased and thereafter, his dead body was recovered, prayer for anticipatory bail of the petitioners is refused.
