The petitioner is accused in connection with Mahila P.S. Case No. 25 of 2016, registered under Section 376, 120(B), 372, 373 of the Indian Penal Code, Section 3/4/5 of I.T.(P) Act, Section 3(I), (XI), (XII) of the SC/ST (P) Act and Section 4/6/8 of POCSO Act, 2012.

The accusation is that informant left her parental house due to quarrel in the family before 4-5 months and reached Patna on boarding in train. In that course, one Sunil Kumar met her, who assured to help her and she was kept by him. Thereafter, he developed physical relation with her and also introduced to one Rekha and she was taken near

Patna High Court Cr.Misc. No.20829 of 2016 (2) dt.20-05-2016 2/2 Rekha, who residing at Chhoti Pahari near Sitla Mandir. Where several people used to visit her house and she was pressed for illicit relation with them on payment of money. In the meantime, she was taken at Biharsharip by the petitioner and one Shela for job in the beauty parlour, where she was pressed to indulge in prostitution and at that time on raising alarm, Police reached there and apprehended petitioner and others.

Learned counsel for the petitioner submits that the petitioner is a lady and has falsely been implicated in this case mere on suspicion and is in custody since 10.03.2016. Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the 1st Addl. Sessions Judge-cum-Special Judge, Biharsharip in connection with Mahila P.S. Case No. 25 of 2016. Out of two sureties, one surety must be the close relative of the petitioner, who will file an affidavit showing his relation with the petitioner.
