This application for grant of anticipatory bail arises out of Simultalla P.S. Case No. 41/2014, disclosing offence under Sections 376, 504 of the Indian Penal Code and Sections 4,6,8,10 and 12 of POSCO Act.
I do not find any substance in the submission made on behalf of the petitioner that he deserves bail on the ground that main allegation is against Brahmdeo Yadav. From the First Information Report, I find that there is allegation against this petitioner also which is specific in nature.
Accordingly, this application for anticipatory bail is, hereby, rejected.
The petitioner is directed to surrender before the Court
Patna High Court Cr.Misc. No.16396 of 2015 (3) dt.13-08-2015 below within six weeks and seek regular bail, if so advised. If he does so, his application for regular bail shall be considered on its own merit without being prejudiced by rejection of present application for grant of anticipatory bail.
