The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 323, 307 and 302/34 of the Indian Penal Code.
Petitioner along with six other accused persons are said to have assaulted the informant and his brother resulting into death of brother of the informant, namely, Vinod Ram. It is submitted by learned counsel for the petitioner that petitioner has no concern with the aforesaid occurrence. She has been falsely implicated in the case due to dirty village politics. Doctor conducting the autopsy of cadaver of the deceased has found only single head injury on the person of the deceased which
Patna High Court Cr.Misc. No.48267 of 2018 (4) dt.28-09-2018 2/2 proved fatal and the said injury is said to have been inflicted not by the petitioner rather by co-accused Mahesh Ram. Petitioner happens to be lady. She has no criminal antecedent. She has been languishing in custody since 04.06.2018. Similarly situated coaccused, namely, Anil Ram, Umesh Ram, Sapna Devi and Phuleshwar Ram have been enlarged on bail by a co-ordinate Bench of this court vide order dated 07.09.2018 passed in Cr. Misc. No. 52297 of 2018.
Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Darauli P.S.
