====================================================== CORAM: HONOURABLE MR. JUSTICE RAKESH KUMAR ORAL ORDER 12-12-2018 Heard Sri Umesh Chandra Verma, learned counsel for the petitioner and Sri Navin Kumar Pandey, learned Addl. Public Prosecutor.

The petitioner, who is in custody in Bettiah Town P.S. Case No.866 of 2017 registered for the offence under Section 365 of the Indian Penal Code, subsequently Section 364 of the Indian Penal Code was added, has prayed for grant of bail It was submitted by learned counsel for the petitioner that the petitioner has been made accused only on the basis of confessional statement of co-accused. However, learned Addl. Public Prosecutor has opposed the prayer for bail and submits that in the case diary, there is sufficient material against the petitioner.

Patna High Court Cr.Misc. No.48206 of 2018(4) dt.12-12-2018 2/2 Considering the nature of accusation as well as facts disclosed in the case diary, I am not inclined to grant bail to the petitioner.

Accordingly, the petition filed for grant of bail stands dismissed.
