2. The petitioner seeks bail in connection with Sessions Trial No. 259 of 2024 arising out of Ujiyarpur P.S. Case No. 296 of 2022 instituted for the offences punishable under Sections 304B, 201/34 of the Indian Penal Code.
3. Allegation against the petitioner is that he along with other co-accused persons have killed his wife.
4. Learned counsel for the petitioner submits that the petitioner is innocent and has committed no offence and has falsely been implicated in this case. He further submits that the marriage of the deceased (daughter of the informant) was solemnized with the petitioner on 28.04.2017 and she was

He next submits that the deceased was blessed with a baby boy on 26.10.2021 but during the course of treatment, the infant got died due to which she was in depression. Petitioner has got no criminal antecedent as stated in para 3 of the petition is in custody since 20.01.2024.
5. Learned APP opposes the prayer for bail.

From perusal of the case diary, FIR and also perused the impugned order dated 19.07.2024 passed by the learned Additional Sessions Judge, Dalsingh Sarai, Samastipur, petitioner is the husband of the deceased. The allegation against the petitioner is that he along with other co-accused persons have caused the dowry death in furtherance of common intention. The death was caused within seven years of marriage. There is specific allegation of demand of dowry and cruelty to the deceased which has been supported by the witnesses in the case diary. It has also come in the case diary that after the occurrence, the petitioner fled away from the place of occurrence and disappeared the dead body of the deceased.
7. Considering the facts and circumstances of the case and submissions of learned counsel for the parties, and
Patna High Court CR. MISC. No.59748 of 2024(3) dt.10-01-2025 3/3 keeping in view the gravity and seriousness of the offence, I am not inclined to grant bail to the petitioner.
8. Prayer for regular bail of the petitioner is hereby rejected.
