JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 08-05-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. After over powering brother of the informant, the miscreants slipped with a tempo. After being informed, informant proceeded to locate the tempo and during the course thereof found the same being driven. After perceiving the same, the accused persons stopped the tempo, got down, escaped, and during the course thereof shot at causing injury near knee of the informant. On hue and cry, the villagers came, chased, apprehended one of them, who disclosed his identity as Irshad Alam and further made an in-culpatory judicial confession naming his associates. From the order impugned it is evident that the witnesses have supported
Patna High Court Cr.Misc. No.17367 of 2015 (2) dt.08-05-2015 the prosecution case and for that the learned lower court has referred to the relevant paras of the case diary. However, the order impugned is absent with regard to conduction of T.I. parade. That being so, petitioner Rabindra Yadav @ Rabendra Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah in connection with Chanpatia P.S. Case No. 20 of 2015.
