The petitioner being the husband of the daughter of the informant is apprehending his arrest in a case registered for the offences punishable under sections 498A, 364/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. Prosecution case is that the informant married his daughter Kashmeera Devi with the petitioner in May, 2011. After one month of the marriage torture was inflicted for non-fulfillment of dowry demand of Rs. 1,50,000/- and thereafter the daughter of the informant was kidnapped and information was given by the petitioner that daughter of the informant flee away from her matrimonial house.

It is submitted by the learned counsel for the petitioner that the petitioner admits his marriage with the informant but the

Patna High Court Cr.Misc. No.21674 of 2016 (3) dt.08-08-2016 informant's daughter eloped with one Sumit Das for which a case was lodged. It is further submitted that co-accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court vide order dated 6.4.2016 in Cr.Misc.No. 5986/2016 and Cr.Misc.No. 9971/2016.

It is submitted by Mr. J.N.Thakur, learned counsel for the State, that the case diary does not reflect that the victim eloped with Sumit Das, rather the case diary suggests that she is traceless. Considering the nature of accusation, let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Kurtha P.S.Case No. 152/2015 pending in the court of Chief Judicial Magistrate, Arwal.

With the aforesaid observation, this application is disposed of.
