2. The petitioner is in custody since 14.03.2016 in connection with Complaint Case No. 353-C of 2001 for the offence alleged under Sections 323, 379 and 147 of the Indian Penal Code.
3. It is submitted that the petitioner has been falsely implicated in the complaint case and no recovery of incriminating goods was made from the possession of the petitioner. It is stated that the petitioner had earlier been granted bail which, however, was subsequently cancelled as he failed to appear before the learned court below on 05.02.2008. It is submitted that the complaint case is of the year 2001 which is pending for disposal.

Having regard to the entirety of the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 20,000/-(twenty thousand) with two sureties of like amount each to the satisfaction of Mr. S.K. Singh, learned Additional Chief Judicial Magistrate, Madhepura in connection with Complaint Case No. 353-C of 2001 with additional condition that the petitioner shall remain personally present as and when required and if he fails to appear on three consecutive dates without sufficient reasons, his bail bond will be liable to be cancelled by the Court concerned.
