The petitioner is apprehending his arrest in a case registered under Sections 323 and 365 of the Indian Penal Code. Allegation is that the accused persons including the petitioner kidnapped the daughter of the complainant with an intention to kill her or to commit sexual assault. It has been submitted on behalf of the petitioner that the there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has falsely been implicated in the present case. There is no substantive evidence to suggest his implication in the present case. Police after investigation has
Patna High Court Cr.Misc. No.15370 of 2017 (2) dt.07-04-2017 2/2 submitted final form against the petitioner. The case has proceeded on the basis of the protest-cum-Complaint petition made by the complainant.
On behalf of the State, it is submitted that the petitioner is named in the protest-cum-Complaint petition. Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of Sri Kumar Amit Manu, A.C.J.M. II, Araria in connection with Complaint case No.1009C of 2012, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
