1. Learned counsel for the petitioner submits that in view of the Division Bench judgment in L.P.A. No. 654 of 2009 petitioner is not pressing the validity of the order of termination. However, his prayer is confined to payment of salary for the period of petitioner has actually worked.
2. Considering the aforesaid the writ petition is disposed of with liberty to the petitioner to file representation before the District Programme Officer (Establishment), Muzaffarpur who shall examine the claim of the petitioner for
Patna High Court CWJC No.15827 of 2009(3) dt.10-08-2018 2/2 payment of the salary for the period petitioner has actually worked.
3. The District Programme Officer (Establishment) Muzaffarpur is directed to examine the claim of the petitioner and pass appropriate order in accordance with law within maximum period of 60 days from the date of receipt/ production of a copy of this order.
4. With the aforesaid the writ petition stands disposed of.
