JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 01-08-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The petitioner apprehends his arrest in connection with Ballia P.S. Case No. 210 of 2016, registered under Section 409 of the Indian Penal Code.

The accusation is that petitioner being the In-charge Headmaster, Primary School, Janipur Tanti Tola, Bellia Block, Begusarai, received amount of Rs.13,00,000/- for construction of the building of school but he constructed the building of the school up to Rs.4,40,271/- and rest amount of Rs.4,59,729/- was misappropriated.

Learned counsel for the petitioner submits that in view

Patna High Court Cr.Misc. No.4108 of 2017 (5) dt.01-08-2017 of the undertaking given by the petitioner before this court on 02.03.2017, petitioner deposited Rs. 4,02,000/- in three installments each on 04.04.2017, 10,07,2017 and 28.06.2017 in the Civil Court, Nagarat, Begusrai, which would appear from Annexure 1 series of the supplementary affidavit. Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Begusarai, in connection with Ballia P.S. Case No. 210 of 2016, subject to the condition as laid down under Section 438(2) of the Cr.P.C. (Rajendra Kumar Mishra, J) Bhardwaj/- U T
