====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR JHA ORAL ORDER 03-05-2017 heard both sides.
The petitioner has filed this petition for modification of the order dated 27.11.2015 passed in Cr. Misc. No. 21876 of 2015 by which the petitioner was granted provisional bail for six months.
Learned counsel for the petitioner submits that period of provisional anticipatory bail may be extended for further six months as the petitioner is appearing on each and every date but, his wife is not appearing in the court even after issuance of notice to her.
Considering the facts aforesaid, I do not find any ground to extend the period of the provisional bail and the court
Patna High Court Cr.Misc. No.16944 of 2017 (2) dt.03-05-2017 2/2 below is directed to pass order on the prayer for bail of the petitioner, taking into consideration the fact of non-appearance of the wife of the petitioner.
With the aforesaid observations, this modification petition is disposed of.
