The petitioner is apprehending his arrest in connection with Kesariya P.S.Case no.125 of 2012 registered for offences punishable under Sections 147, 148, 149, 324, 307, 387, 504 and 323 of the Indian Penal Code and Section 2/4 of the explosive Substance Act.

Submission of the learned counsel for the State is that process under Sections 82 and 83 Cr.P.c. has already been complied against the petitioner as such this application is not maintainable.

In view of the facts and circumstances, let the petitioner surrender before the learned court below and make prayer for

Patna High Court Cr.Misc. No.17169 of 2018 (4) dt.31-07-2018 2/2 regular bail, which will be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
