08-01-2015 Heard learned counsel for the petitioner and Sri Anand Kumar Ojha, learned counsel who has appeared on behalf of all the respondents.

The petitioner, who retired as Bill Clerk, Electric Supply Division, Beerpur, Supaul w.e.f. 31-07-2013, has approached this Court by invoking its writ jurisdiction under Article 226 of the Constitution of India, with a prayer to direct the respondents to pay amount under the head of Gratuity, Leave Encashment, G.S.S., G.P.F. and also revision of pay with penal interest.

At the very outset, on instruction, Sri Ojha, learned

Patna High Court CWJC No.2717 of 2014 (3) dt.08-01-2015 2/2 counsel for respondents submits that the petitioner has already been paid the amount under the head of G.P.F., Un-utilised Leave & G.S.S. and the petitioner is getting 90% provisional pension. He submits that steps are being taken to settle entire retiral dues of the petitioner.

Keeping in view the fact that the petitioner has already retired and some of the retiral dues have already been settled, no purpose would be served in keeping the matter pending. The writ petition stands disposed of with a direction to respondents, particularly; respondent no. 2/Managing Director, North Bihar Power Distribution Co. Ltd. to take all steps for settling all the retiral dues in accordance with law within a period of two months from the date of receipt/production of a copy of this order. It goes without saying that the petitioner would be entitled to get statutory interest on the retiral dues, if not paid. (Rakesh Kumar, J.) Anay/- U
