The petitioner apprehends his arrest in a case registered for the offences punishable under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and is nephew of the informant, it is next submitted that earlier the father of the petitioner had instituted Sono P.S. Case No. 341/2019 against the present informant and other accused persons as such the petitioner came to be implicated in the present case on the ground that his name transpired in the confessional statement of Panchu Ram with respect to a theft of motorcycle of the informant.

Learned counsel for the petitioner submits that

Patna High Court CR. MISC. No.68803 of 2021(2) dt.25-07-2022 2/2 Panchu Ram has been granted the privilege of anticipatory bail by order dated 27.10.2021 in Cr. Misc. No. 40336 of 2020, it is next submitted that though during the course of investigation it has come that some parts of the motorcycle were recovered from the house of the petitioner but those parts were of the motorcycle of the petitioner and not of the informant but the informant came to be implicated because is having dispute with the petitioner.

Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/successor court in connection with Sono P.S. Case No. 70 of 2020 subject to the conditions as laid down under Section 438 (2) of the Cr.P.C.
