The petitioner seeks regular bail in connection with Rautara P.S. Case No. 96 of 2017, registered for the offence punishable under Sections 498(A) and 302/34 of the Indian Penal Code.
The allegation in the present case is regarding the petitioner subjecting the sister of the informant to cruelty and torture both mentally and physically on account of nonfulfillment of the dowry demand. This Court had earlier issued notice to the Opposite Party No. 2 whereafter, the Opposite Party No. 2 has filed
Patna High Court Cr.Misc. No.50090 of 2018(4) dt.12-12-2018 2/2 Vakalatnama through Mr. Nadimal Hasan, learned counsel. The learned counsel appearing for the Opposite Party No. 2 submits that the matter has been settled amicably for the moment, hence, he is not opposing the prayer for bail. Having regard to the facts and circumstances of the case, as also having regard to the fact that the learned counsel for the Opposite Party No. 2 has got no objection to grant bail to the petitioner herein, I deem it fit and proper to enlarge the petitioner on regular bail.
Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Katihar, District-Katihar in connection with Rautara P.S. Case No. 96 of 2017.
