Mr. Nagendra Prasad, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-08-2019 Petitioner seeks bail in connection with Sangrampur P.S. Case No. 34 of 2018, for the offences under Sections 341, 302, 120B, 34 of IPC.
Earlier prayer for bail of the petitioner was rejected by this Court, vide order dated 09.10.2018, passed in Criminal Misc. No. 53308 of 2018.
Allegation against the petitioner is of surrounding the informant and other accused persons and made firing on him. Further allegation is that he fired on him, causing injury on the back side of the deceased.
Submission of learned counsel for the petitioner is that he is in custody for more than a year. Now charge has also been framed and he undertakes that he will co-operate in disposal of the trial.
Heard learned APP also, who has opposed the prayer for
Patna High Court CR. MISC. No.53433 of 2019(2) dt.28-08-2019 2/2 bail on the ground that he has criminal antecedent also. Having heard both sides, considering the circumstances of this case at this stage, I am not inclined to grant privilege of bail to the petitioner. However, since the petitioner is in custody and charge has been framed, let the trial court is directed to expedite the trial and if possible to conclude the same within a period of 09 months, if the trial court is not concluded the trial within the time prescribed above, the petitioner is at liberty to move for renewal of his prayer for bail.
