The petitioners are apprehending their arrest in connection with Shahkund P.S.Case No. 101 of 2005 registered for the offences punishable under Sections 304B, 120B and 201 of the Indian Penal Code.

It has been submitted on behalf of the petitioners that petitioners were granted anticipatory bail by learned Sessions Judge itself but due to wrong advice they could not deposit bail bonds and due to non-appearance their case was separated from the other accused and trial has been concluded and order of acquittal has been passed. Now warrant has been issued against the petitioners and they have come before this Court for grant of

Patna High Court Cr.Misc. No.14842 of 2017 (2) dt.04-04-2017 2/2 anticipatory bail.

Heard learned APP also.

Having heard both sides and in view of the fact that earlier anticipatory bail was granted by learned Sessions Judge, it is not a case of anticipatory bail, rather petitioners should surrender and make regular bail application before the court below, which shall be considered and disposed of keeping in view of the fact that earlier anticipatory bail was granted to the petitioners.
