The petitioner apprehends his arrest in Mahila P.S. Case No. 1 of 2015, registered for the offences punishable under Section 498A and other sections of the Indian Penal Code. The wife made allegation against the petitioner about the demand of dowry and torture.
Learned counsel for the petitioner submits that the petitioner is ready to keep his wife. It is also submitted that petitioner has made this statement on oath but from perusal of the order of the learned Sessions Judge, it appears that the wife and the petitioner were present before the learned Sessions Judge. The wife was willing to live with her husband but the petitioner did not
Patna High Court Cr.Misc. No.16599 of 2015 (2) dt.01-05-2015 agree to live with his wife.
Considering the facts aforesaid, I am not inclined to enlarge the petitioners on anticipatory bail. Accordingly, the prayer for anticipatory bail of the above named petitioner is rejected in connection with Mahila P.S. Case No. 1 of 2015, pending in the court of the learned Chief Judicial Magistrate, Lakhisarai.
