The petitioner apprehends his arrest in connection with Saraiya P.S. Case No.773 of 2021 registered under Sections 272, 273, 34 of the Indian Penal Code and Section 30 (a) of the Bihar Prohibition and Excise Act and 20/22 of the N.D.P.S. Act. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He also submits that the name of the petitioner surfaced in this case on the basis of confessional statement of co-accused. The alleged recovery has been made from the field near Manikpur High School. The petitioner has got no criminal antecedent.

Having considered the above facts and the

No.56145 of 2022(3) dt.02-01-2023 2/2 submissions advanced on behalf of the parties, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing personal bond to the satisfaction of Special Judge, Excise Act, Muzaffarpur in connection with Saraiya P.S.
