The petitioner has renewed his prayer for bail in a case registered under sections 8, 15(c), 25 and 29 of the NDPS Act.

It is submitted by learned counsel for the petitioner that the earlier application for bail of the petitioner was rejected vide order dated 27.4.2021 (Annexure-1) passed in Cr. Misc. no.35693 of 2015.

It is submitted by learned Senior Counsel appearing for the petitioner that the premises in question was rented out by the father of the petitioner to one Maqsood Alam for running a hospital on rent of Rs.12000/ per month. No incriminating article has been recovered from the conscious possession of the

Patna High Court CR. MISC. No.67033 of 2021(2) dt.08-12-2021 2/2 petitioner instead the recovery is from the hospital which was being run by the coaccused. The petitioner is in custody since 18.7.2020 and has been falsely implicated because of his antecedents.

Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for over 1 year 4 months, the Court directs the petitioner to be enlarged on bail in connection with Barun P.S. Case no. 127 of 2020 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional District and Sessions Judge-cum-Special Judge, Aurangabad.
