In the present case, the petitioners are apprehending their arrest in connection with Pandol P.S. Case No. 162 of 2016 for offence under 437, 148, 149, 341, 323, 324, 354, 307, 379, 504 and 427 of the Indian Penal Code.
There is a case and counter case from both sides. An allegation has been made the Informant was ploughing his field then all of a sudden the accused persons including the petitioners came there and assaulted the Informant and other persons including the female members.
Patna High Court Cr.Misc. No.20390 of 2017 (3) dt.06-07-2017 There is a specific allegation against Basant Yadav, petitioner no.4. Accordingly, this Court is not inclined to grant privilege of anticipatory bail to the petitioner no.4, namely, Basant Yadav.
With respect to other petitioners i.e. petitioner nos. 1, 2 & 3, there is no whisper to have participated in the alleged offence.
Looking to the entire facts and circumstances of the case, let the petitioner nos. 1, 2 & 3, namely, Ram Parikshan Yadav, Kari Yadav and Chhotu Yadav, in the event of their arrest or surrender before the court below within a period of four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Madhubani in connection with Pandol P.S.
